Writer's Rolodex provides users ("you" or "users") with an AI-powered tool to analyze book manuscripts and query letters to generate personalized recommendations, including potential literary agents to contact.

Key Features:

• Securely upload book manuscripts, synopses, and other related materials.
• Receive AI-generated insights and recommendations for literary agents based on a proprietary dataset.
• Submit personal and manuscript-related information to enhance recommendation accuracy.

Limitations:

• We do not guarantee that literary agents will respond, review, or accept your manuscript.
• Our recommendations are generated based on algorithmic predictions and should not be relied upon as professional advice.
• You are responsible for verifying the suitability of any recommended agent.

3. User Responsibilities

3.1 Content Upload & Use

By using the Platform, you confirm that:

• You either own or have the necessary rights to submit the content.
• Your submitted content does not violate any laws, infringe copyrights, or contain malicious software.
• You will not upload content that is illegal, harmful, or misleading.

3.2 Accuracy of Information

• You are responsible for ensuring that all information you provide (including manuscript metadata and personal details) is accurate and truthful.
• Inaccurate information may affect the quality and relevance of recommendations.

3.3 Prohibited Conduct

You may not:

• Attempt to extract, copy, or reproduce our proprietary literary agent dataset.
• Use the AI-generated recommendations for commercial resale or distribution.
• Engage in any actions that compromise the security or integrity of the Platform.

4. Intellectual Property Rights

4.1 User Content

• You retain full ownership of your uploaded manuscripts and associated content.
• By using the Platform, you grant us a non-exclusive, worldwide, royalty-free license to process your content for the purpose of providing and improving our services.

4.2 AI Training & Data Use

• Your manuscript data will be securely stored but not anonymized unless otherwise specified.
• We may use anonymized user data to refine and improve AI-generated recommendations, subject to your consent.

4.3 Proprietary Literary Agent Dataset

The literary agent dataset, including but not limited to names, interests, submission preferences, and personas, is a proprietary compilation created and owned by Début Studio Inc. ("Company"). While individual pieces of information may be publicly accessible, the Company's dataset, including its selection, categorization, and analysis, is the result of significant proprietary effort and is protected under applicable intellectual property laws, trade secret protections, and database rights.

User Restrictions:

• Users may not copy, scrape, distribute, modify, or otherwise extract information from the dataset.
• Users may not use the dataset for commercial purposes, including creating a competing service.
• Users may not attempt to reverse-engineer or decompile the dataset.
• Users may only access and use the recommendations provided by the AI for personal manuscript submissions.

5. Data Privacy & Security

5.1 Data Collection

We collect:

• Manuscript and Query Letter Content (for AI processing).
• Personal Information (such as bio, email, and manuscript metadata).
• Form Responses (used to tailor AI recommendations).

5.2 Data Security

We implement industry-standard security measures to protect stored data, including:

• Encryption of raw files during storage and transmission.
• Firewall protection and access controls.
• Regular security audits to assess risks.

5.3 Data Retention & Deletion

• Manuscript data is stored only as long as necessary to provide services.
• Users may request deletion of their manuscripts by emailing us, with removal occurring within two (2) weeks.

5.4 Third-Party Data Sharing

We use OpenAI's API to process AI-generated responses. Data sharing is governed by OpenAI's privacy policies:

• OpenAI Privacy Policy (Regular)
• OpenAI Privacy Policy (Enterprise)
• We do not share user data with literary agents or other third parties.

5.5 Data Breach Response

In the event of a data breach, we will:

• Assess the impact and determine affected data.
• Notify affected users with relevant details and recommended actions.
• Take corrective measures to prevent future incidents.

6. Disclaimers & Liability

6.1 AI-Generated Recommendations

• Our AI-generated recommendations are for informational purposes only.
• We do not guarantee agent responses, acceptance, or publishing success.
• Users are solely responsible for their interactions with literary agents.

6.2 Limitation of Liability

• Writer's Rolodex is not responsible for any negative outcomes arising from recommendations (e.g., rejections, disputes, plagiarism claims).
• We are not liable for any direct, indirect, or consequential damages related to the use of the Platform.

6.3 No Legal or Professional Advice

• The Platform does not provide legal, business, or professional publishing advice.
• Users should consult appropriate professionals for guidance on agent submissions and publishing contracts.

7. User Conduct & Restrictions

7.1 Testing Content Not Owned by the User

• If you upload content that is not your own, you must have legal authorization to do so.
• Misuse of third-party content is a violation of these Terms and may result in account termination.

7.2 Use of Recommendations

• The AI-generated agent recommendations are for personal use only.
• Users may not share, sell, or distribute recommendations outside of their own literary pursuits.

8. Paid Features & Future Monetization

• We may introduce paid features or premium memberships in the future.
• Any pricing changes or subscription models will be disclosed in updated Terms before implementation.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Delaware, and the decision of the arbitrator shall be final and binding. You waive any right to participate in a class action lawsuit or class-wide arbitration.
